LITTLETON ZONING BOARD OF ADJUSTMENT
APPROVED MINUTES
TUESDAY, FEBRUARY 23, 2010
COMMUNITY CENTER, HEALD ROOM
7:00 PM
Present: Chairman Eddy Moore, Vice Chair Mike Lombardi, Richard Merrow, Eugene Langdoc, Kyle Jensen (Alternate), and Joanna Ray, recording secretary.
Excused: Donna Trahan

Chairman Moore called the meeting to order at 7 PM. The first cases, ZBA10-04 & 05 & 06 will not be heard. The Planning / Zoning office received the wrong Bethlehem abutter addresses. The cases were not properly notified. The applicant has been informed the hearing will be noticed for the March 23, 2010 meeting.
Herb Lahout, Owner / Horizons Engineering, Agent – ZBA10-04 – Request for a Special Exception relating to Article IV, Section 4.02.01 of the Littleton Zoning Ordinance to allow 7 multi-family buildings containing 56 units off of Joe Lahout Ln, tax map 100-14, in the R-I zone.
Herb Lahout, Owner / Horizons Engineering, Agent – ZBA10-05 – Request for a Variance relating to Article IV, Section 4.02.01 of the Littleton Zoning Ordinance to allow warehouse units off of Joe Lahout Ln, tax map 100-14, in the R-I zone.
Herb Lahout, Owner / Horizons Engineering, Agent – ZBA10-06 – Request for a Variance relating to Article V, Section 5.01 of the Littleton Zoning Ordinance to allow non-conforming setbacks off of Joe Lahout Ln, tax map 100-14, in the R-I zone.
Miriam E. Daine, Trust / Judith D. Foster & Nancy A. Champagne, Trustees – Applicants – ZBA10-07 – Request for an Equitable Waiver of Dimension relating to Article V, Section 5.01 of the Littleton Zoning Ordinance to allow non-conforming setbacks at 1579 Monroe Rd, tax map 40-10, in the Rural zone.
Kyle Jensen will be a voting member tonight. Eugene Langdoc made a motion to accept the application. Vice Chair Lombardi seconded the motion. The motion passed 5-0. The abutters were notified. The case was noticed in the Caledonian Record. The case fees were paid. A building permit was issued in 1997. There were no conflicts between the applicant and any Board member.
Nancy Champagne submitted a survey from 2008 that shows how close the garage is to the property line. The garage is approximately 38’ from the property line and a 50’ R.O.W. The required setback in the Rural zone is 50’. The abutting properties always stayed in the family. The garage was built in its current location because of the location of the driveway. The R.O.W. adds a buffer between the lots. No one can build in this area.
There were no other comment or questions. Chairman Moore read the applicants responses to the questions on the application. The applicant was unaware that the garage setbacks were too close. The waiver will bring the house into compliance with Town regulations. There were no concerns back in 1997.
The public input portion of the hearing was closed. Vice Chair Lombardi stated that he had no problem with granting this. Chairman Moore said that evidence shows this situation lasting over 10 years. Chairman Moore did not feel that this was built with bad faith or intentional breaking of the law. Everyone agreed.
Eugene Langdoc made a motion to grant Miriam E. Daine, Trust / Judith D. Foster & Nancy A. Champagne, Trustees – Applicants – ZBA10-07 – Request for an Equitable Waiver of Dimension relating to Article V, Section 5.01 of the Littleton Zoning Ordinance to allow non-conforming setbacks at 1579 Monroe Rd, tax map 40-10, in the Rural zone due to the following facts:
Ø There is a 50’ R.O.W. buffer between the garage and the abutting property
Ø Granted the garage to be only short 12’ of the required 50’
Ø Error exceeds 10 years
Ø The submitted plan must be part of the decision
Vice Chair Lombardi seconded the motion. The motion passed 5-0.
The minutes from 2-09-10 will be reviewed and discussed at the 3-23-10 meeting.
Richard Merrow made a motion to adjourn at 7:30. Vice Chair Lombardi seconded the motion. The motion passed 5-0.
