LITTLETON BOARD OF SELECTMEN

WORK SESSION

LITTLETON TOWN OFFICE CONFERENCE ROOM

AUGUST 2, 2006


Present: Chairman George Hicks, Selectman Burt Ingerson, Selectman Ed Farrell, Interim Town Manager Tony Mincu


Chairman George Hicks opened the work session at .


Tony Mincu handed out a public statement (see copy attached). The statement was signed by the Selectmen and read aloud to those present. The statement noted that while all allegations made by Growth With Common Sense do not have merit, some do and need to be addressed by the Selectmen. The statement also urges voters to come together to work out the problems facing the town especially in regard to finding a suitable location for the Police Department, both temporary and permanent.


Jae Whitelaw from Mitchell & Bates stated the Selectmen must decide if they will petition the Court for a Special Town Meeting to address the lease issue. If the Selectmen decide a Special Town Meeting is necessary and vote to petition the Court, the Court will decide if the need is an emergency. They will reach a decision based on the severity or emergency of the need, was the need foreseeable or could it have been avoided and could it have been addresses at the last Town Meeting. Lastly, the court will decide if there is an alternate solution to the issue. Ms. Whitelaw stated she feels the Town can make a good argument to the Court even though it was addressed in March due to the confusion on the ballot at the time of the Town Meeting. The Selectmen must plan on a minimum of at least sixty days from the time they vote to petition the Court to the time of the Special Town Meeting due to legal timelines, which must be met.


The Selectmen agreed that a Special Town Meeting in late October or early November would be desirable.


Selectman Farrell asked about the feasibility of addressing some of the Opera House issues at the same time. He would like to see the structural problems corrected at least enough to keep the building standing.


Tony presented handouts of recommendations for the Police Department made by the Citizens Advisory Board. He would like the Selectmen to review the recommendations and provide feedback at the next Selectmen’s Meeting. The CAB will be available at that Meeting to answer any questions the Selectmen may have.


Tony told Selectman Ingerson he had been unable to obtain a video tape of the 1999 Town Meeting as requested because they are only kept on file for a short time.


Selectman Ingerson stated he would like to know how often the bridges in Town are washed. They need to be washed down and sprayed with linseed oil.

Tony informed the Selectmen there will be a staff meeting every Monday morning at 9:30 am. Department Head meeting will take place bi-weekly, with the first meeting schedule for August 15.


Selectman Farrell expressed an interest in attending the staff meeting to keep up with what is going on.


At this time, Selectman Farrell moved to go into non-public session per 91-A to address litigation and personnel issues. The motion was seconded by Selectman Ingerson and carried 3-0. The Board Members were polled all agreement to go into non-public session.
