Approved Zoning Board Minutes Dec 22, 2015

6:00 PM

Present: Chairman Eddy Moore, Vice Chair Sean Sweeney, Art Tighe, Guy Harriman, Jerry LeSage, and Joanna Ray (recording secretary)
Excused: Heidi Hurley & Jessica Daine
Others: Kevin Low, Darin Wipperman (Courier reporter)

Chairman Moore called the meeting to order at 6:00 and designated Guy Harriman and Jerry LeSage as voting members for this meeting. There were no conflicts noted.

CONTINUATION: Secured Network Realty LLC, Owner – ZBA15-12
Art Tighe stated the reason for the continuation was to allow the applicant time to produce a letter stating that SNS is in compliance with FCC guidelines and to provide written proof, from a licensed surveyor, that the proposed PWCF is at least 1-mile from the closest PWCF tower. Regional notification of the PWCF was not required. The PWCF will not be seen from any surrounding municipality. Vice Chair Sweeney stated the submitted letter from Ubiquiti Networks is sufficient proof of the applicant being compliance with FCC guidelines. Eric Pospesil, NH land surveyor, confirmed the distance to the closest PWCF is 5,322 feet =/- 10 feet based on rounding to a tenth of a second of arc.

The fall zone was discussed. At the November 24, 2015 hearing, the applicant produced a plan showing the fall zone is met or exceeds the requirement.

Chairman Moore stated the height of the PWCF was questioned at the November 24th hearing. Town Counsel confirmed the height of the tower falls under different guidelines than a structure as defined in the zoning ordinance.

Kevin Low stated the tower off Slate Ledge Road will be using this PWCF. This will be a great improvement in this area of town. The Police and Fire Departments will also benefit. This is not cellular service, only data.

There were no other concerns or questions. Chairman Moore closed the public input.

Vice Chair Sweeney made a motion to approve Secured Network Realty LLC, Owner – ZBA15-12 – Request for a Special Exception relating to Article IV, Section 4.02.06 of the Littleton Zoning Ordinance to allow a 45’ tall Personal Wireless Communication Facility attached to the building at 775 Industrial Park Rd, tax map 91-55, in the Industrial zone, based on the submitted information, with the condition that the work be in compliance with all Federal, State, and Local regulations. Jerry LeSage second the motion. The motion passed 5-0. The applicant was informed of the 30-day appeal period before the building permit can be issued.
