PRESENT:  Chair Jessica Daine, Vice Chair Eddy Moore, Jerry LeSage, David Rochefort, Ralph Hodgman, Jim McMahon, and Joanna Ray (recording secretary)

Chair Daine called the meeting to order at 6:00 and announced the only hearing on the agenda.

 

Erik & Heather Flum, Owners & Applicants – ZBA18-03 – Request for a Special Exception relating to Article VI, Section 6.12 of the Littleton Zoning Ordinance to allow the raising of chickens at 70 Russell Court, tax map 54-27, in the R-2 zone. The application was complete, fees were paid, abutters were notified, and the hearing notice was in the newspaper. There were no conflicts noted. 

 

Chair Daine read the submitted facts.  The enclosure will be kept near the shed and away from property lines, almost in the middle of the lot.  There is plenty of space and the location is fairly secluded.  Waste will be composted in the woods.  Property values should not be affected by the raising of chickens.  The backyard is a secluded location and the chickens will be kept in a fenced area with a nice coop. The applicant did not feel that a nuisance or unreasonable hazard would result.  The coop and fenced area will be built to contain the chickens.

 

Erik Flum explained that he wants chickens for egg production for his family.  This is a secluded area with a deer farm down the road.  There will be no negative impact with the small backyard flock.  Vice Chair Moore asked if there was a maximum amount of 10 chickens.  Erik replied that there would be around 10 hens.  Jerry asked if there would be any roosters.  Erik replied that he is not planning on that. Jim asked Erik if he had read the ordinance requirements associated with raising chickens. Erik replied yes.  The property is 250’-300’ wide and the chickens will be away from the property line.  Jerry asked if there would be a coop.  Erik replied yes and that the coop would have a fenced area. 

 

Ralph asked about the drainage ditch in the back of the coop area. Erik replied that it is not a running stream and that it is dry in the summer.  It is mostly wet from the melting snow.  Ralph asked about the plan for composting.  Erik said he will use pine shavings in the coop.  The waste mixed with the pine shavings will be mixed into a compost structure to eventually be used as fertilizer for gardening.  Erik confirmed that he was aware of the required pen and exercise yards.  The chickens are not roaming around the property.

 

Health Officer Bratz offered information to the applicant regarding bacteria and diseases associated with chickens.

 

Jim asked about the location of the compost.  Erik replied that it will be about 30’-40’ away from the chickens and not near the property lines. 

 

Chair Daine closed the public input and the Board discussed the findings of the facts.

 

  • The location has approximately 3 acres.  The chickens will be in the middle of the property.  The location makes this appropriate.
  • The chickens will be surrounded by woods and will have little to no impact on the neighborhood.
  • There is adequate housing and not near the neighbors.  The chickens will be contained.
  • The applicant is aware of the setback requirements, shelter and enclosure requirements, and plans to build the appropriate facility.

 

All Board members agreed with the findings of the facts. 

 

Ralph Hodgman made a motion to approve Erik & Heather Flum, Owners & Applicants – ZBA18-03 – Request for a Special Exception relating to Article VI, Section 6.12 of the Littleton Zoning Ordinance to allow the raising of chickens at 70 Russell Court, tax map 54-27, in the R-2 zone with the following condition:

 

  • The applicant must comply with all Federal, State, and Local regulations.

 

Jerry LeSage seconded the motion.  The motion passed 5-0.

 

Review Minutes

March 27, 2018 – review was postponed until April 24, 2018

 

Other business

Board appointments and reappointments will be at the April 16, 2018 Board of Selectmen meeting at 5:00 PM in the Community House Heald Room.

 

The ZBA bylaws state:

Sec. 4  Elections: Members shall be notified in writing of the date, time, and place of the election of officers at least ten (10) days prior to the first regular May meeting. Each officer shall serve until relieved of his or her duties as herein provided.

           

           

At 6:25, Chair Daine made a motion to adjourn.  Jerry seconded the motion.  The motion passed.
