PRESENT:  Chair Jessica Daine, Vice Chair Jerry LeSage, Ralph Hodgman, David Rochefort, George Morgan, and Joanna Ray (recording secretary)

 

EXCUSED:  Jim McMahon,Guy Harriman and Eddy Moore

 

OTHERS:  Zoning Officer Milton Bratz

 

Chair Daine called the meeting to order at 6:00.  George was designated as a voting member for this meeting.

 

Discuss the Motion for Rehearing of:

REL Commons LLC – Appeal of Building Permit#19-0423-01 issued to Coastal Construction Corp. for the construction of Convenient MD located at 551 Meadow Street, tax map 76-12, in the C-I zone.  All Board members stated they read the submitted request for a rehearing.  Chair Daine stated she did not see a reason to grant a rehearing.  David agreed.  Some items were discussed at length at the original hearing.  David stated he does not feel that there was a violation of any RSA. George was not at the original hearing, but had reviewed the minutes as well as the submitted request.  He did not see anything new.  Vice Chair LeSage agreed.  Ralph asked if all documents were in place when the building permit was issued.  Milton replied that as far as he knew, yes they were.  The Fire Chief had a set of plans. Chair Daine stated the minutes confirmed the permit was issued when it should have been. Atty. Hollis and an email confirmed it as well.  The job description for the Zoning Officer says nothing about reading construction plans.  Ralph added that the ZBA did not have a set of the plans prior to the hearing when the permit was issued.  Chair Daine replied that the ZBA would not have any reason to have a copy of the plans because the project met the zoning requirements.  

Vice Chair LeSage made a motion to deny the request for a rehearing of REL Commons LLC – Appeal of Building Permit#19-0423-01 issued to Coastal Construction Corp. for the construction of Convenient MD located at 551 Meadow Street, tax map 76-12, in the C-I zone.  David seconded the motion.  The motion passed unanimously.

Review of minutes:

May 28, 2019.  Vice Chair Lesage made a motion to approve the minutes as written.  George seconded the motion.  David abstained from the vote.  The motion passed 4-0.

June 17, 2019.  Suggested edits were submitted to the Board.  The Board felt the draft copy accurately reflected what transpired at the hearing.  George made a motion to approve the minutes as written.  Ralph seconded the motion.  The motion passed by all.

June 25, 2019.  Ralph made a motion to approve the minutes as written.  Vice Chair LeSage seconded the motion.  The motion passed by all.

Other business

After a brief discussion, the ZBA would like the Planning Board to review the height requirements listed in section 5.01 of the Littleton Zoning Ordinance.  During a recent ZBA hearing, the reason for the 35’ limit came up.  There was a general consensus that the reason was based on the previous fire department apparatus. 

At 6:45, David made a motion to adjourn.  Vice Chair LeSage seconded the motion.  The motion passed by all.
