Present: Chairman Ron Bolt, Vice Chairman Ed Boynton, Selectman Marghie Seymour, and Executive Secretary Ceil Stubbings

Chairman Bolt called the meeting to order at 10:20 AM.

The board then reviewed the following tax abatements with Richard Dorsett from MRI as follows:

New Hampshire Electric Cooperative Inc., B-) St. Johnsbury Road, Tax Map 999-002, Tax Year 2009 – Amount $0.
The subject is the NH Electric Coop utilities within the town. The reason for the request was the owner’s concern with the assessment in relation to their opinion of the Value of $350,348. The subject is currently assessed at $902,400. The abatement and assessment for the subject is handled by George E. Sansoucy, PE, LLC. I requested additional information to be provided to Sansoucy on behalf of the town. No information was submitted and it is my recommendation that the abatement request be denied. Seymour made the motion to deny the above abatement as listed. Boynton seconded the motion. Motion passed 3-0.

Willow Street Associates, 35 Crane Street Tax Map 85-75, Tax Year 2009 – Amount $13,783.63.
The subject property is an apartment complex on a 2.77-acre parcel. The reason for the request is the owner’s concern with the assessment in relation to what they believe the assessment should be under RSA 75:1(a), the Low Income Housing Tax Credit Program. Their opinion of value is $1,248,000. In 2009 they applied under this law, which allows an alternate tax either based on 10% of actual income or the income approach based on restrictions within a Land Use Restriction Agreement (LURA). In 2009 no LURA was provided and the assessment was based on the income approach using the fair market rents as established by the New Hampshire Housing Finance Authority. Financial statements were provided and it was determined that 100% of the apartments are to be rented to those with household income at or below 60% of the area median gross income (AGMI). The maximum rent that can be charged for these apartments is $615 or 80% of the NHHFA maximum rent and $655 or 70% of the NHHFA maximum rent. As this information was supplied, it is recommended and required that we use these figures to calculate the assessment for 2009. After calculations the assessment is reduced $654,968 from $2,298,400 to $1,643,432 and it is recommended that an abatement in the amount of $13,783.63 be granted. Seymour made the motion to approve the above abatement as listed. Boynton seconded the motion. Motion passed 3-0.

G. David Keller, Hillside Avenue, Tax Map 78-36, Tax Year 2009 – Amount $0.
The subject property is a 0.21-acre parcel. The reason for the request was the owner’s concern with the assessment in relation to the purchase price of $15,000 on 8/14/2009 and that the listed outbuildings had no value. The subject is currently assessed at $16,600 and was assessed at $27,300 for 2009. All information provided was reviewed and I inspected the subject and found that the outbuildings were there as of April 1 and considered taxable for the 2009 tax year. It is my recommendation that the abatement request be denied. Note: The buildings have been removed for the 2010 tax year. Seymour made the motion to deny the above abatement request as listed. Boynton seconded the motion. Motion passed 3-0.

G. David Keller, 101 Union Street, Tax Map 79-65, Tax Year 2009 – Amount $0.
The subject property is a funeral home on a 0.29-acre parcel. The reason for the request was the owner’s concern with the assessment in relation to the purchase price of the property of $200,000 on 8/21/2009. The subject is currently assessed at $270,300. All information provided was reviewed and I inspected the subject and found some minor physical data errors, which did not effect the assessment. The closing statement and a breakdown of personal property included in the sale were provided. However, no additional information was available such as an appraisal or income data to provide validity or support the purchase price. It is my recommendation that the abate request be denied. Seymour made the motion to deny the above abatement request as listed. Boynton seconded the motion. Motion passed 3-0.



New Hampshire Electric Transmission Company, B-O St. Johnsbury Rd., Tax Map 999-006, Tax Year 2009 - Amount $0. The subject is the NH Electric Transmission Company utilities with the town. The reason for the request was the owners concern with the assessment in relation to their opinion of the value of $7,673,280. The subject is currently assessed at $9,773,700. The abatement and assessment for the subject is handled by George E. Sansoucy, PE, LLC. Based on the information provided by the utility it is recommended that the abatement request be denied. Note: See attached letter from Sansoucy recommending that the abatement be denied. Seymour made the motion to deny the above abatement request as listed above. Boynton seconded the motion. Motion passed 3-0.

Chairman Bolt asked for a motion to adjourn. Boynton moved to adjourn. Seymour seconded the motion. Motion to adjourn passed 3-0. The meeting adjourned at 10:55 AM.
